These Terms and Conditions ('Terms') govern your use of the Darkness Within website located at darknesswithingifts.com.au ('Site') and the purchase of products from us. By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

Darkness Within ('we', 'us', 'our') is an Australian-based retailer of gothic giftware, jewellery, homewares, ritual tools, and home fragrances. Our registered business operates in Australia and all transactions are conducted in Australian Dollars (AUD).

By using our Site, you confirm that you are at least 18 years of age, or are accessing the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms. We reserve the right to refuse service to anyone at our sole discretion.

All product descriptions, images, and prices are provided in good faith and are subject to change without notice. We make every effort to display product colours and details accurately; however, we cannot guarantee that your device's display will accurately reflect the actual product. Prices are listed in Australian Dollars and include GST where applicable. We reserve the right to correct any pricing errors and will notify you before processing your order if a correction is required.

When you place an order, you are making an offer to purchase the selected products at the listed price. We reserve the right to accept or decline any order. Your order is confirmed once you receive an order confirmation email. Payment is processed securely via Stripe. By providing your payment details, you confirm that you are authorised to use the payment method and that the information provided is accurate. We do not store your full card details on our servers.

We ship Australia-wide. A flat shipping rate of $12.00 applies to all orders, with free shipping on orders over $110.00. Estimated delivery times are provided as a guide only and we are not liable for delays caused by third-party carriers, customs, or circumstances beyond our control. Risk of loss and title for products pass to you upon delivery to the carrier. Please refer to our Shipping & Returns page for full details.

We accept returns within 14 days of delivery for items that are unused, in their original condition, and in original packaging. To initiate a return, please contact us at [email protected] with your order number and reason for return. Return shipping costs are the responsibility of the customer unless the item is faulty or incorrectly sent. Refunds are processed to the original payment method within 5–10 business days of receiving the returned item. We do not accept returns on sale items, digital products, or items that have been used or damaged after delivery.

All content on this Site — including text, images, graphics, logos, product descriptions, and design — is the property of Darkness Within or its content suppliers and is protected by Australian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our express written permission.

To the maximum extent permitted by Australian law, Darkness Within shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or products, including but not limited to loss of profits, data, or goodwill. Our total liability to you for any claim arising from these Terms or your use of our Site shall not exceed the amount you paid for the relevant order. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Your use of our Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Site, you consent to the collection and use of your information as described in our Privacy Policy.

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of our Site shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
